Matrimonial Home: Ontario vs. BC

Both Ontario and BC recognize the concept of a matrimonial home (called a “family residence” in BC), meaning a property where spouses ordinarily live together.

The key difference lies in property division:

  • In Ontario, the entire value of the matrimonial home must be shared upon separation, even if one spouse owned it before marriage.
  • In BC, only the increase in value after the relationship began is divided, allowing spouses to keep pre-relationship equity.
